There are 3 legal ways to homeschooling in California, which can be explained via the statewide homeschool organizations:
• California Homeschool Network (CHN) https://www.californiahomeschool.net/
• The Homeschool Association of California https://www.hsc.org/
• Christian Home Educators Association of CA https://www.cheaofca.org/

An Overview of the Laws:
Way 1: Homeschooling as a home-based private school.
To do this, each year, the parents file a Private School Affidavit, also known as an R-4, with the state Superintendent of Education. You can obtain the Affidavit and all information, here: https://www.cde.ca.gov/sp/ps/affidavit.asp

Way 2: Homeschooling with a private school satellite program (PSP).
In this scenario, parents enroll their child with the PSP, which charges tuition and provides all record-keeping – grades, testing results, attendance, as well as curriculum guidance, etc.

Way 3: Homeschooling via instruction by a private tutor
In this way, the parents employ an instructor with a California teaching credential for the grade level(s) being taught.
Instruction must be for a minimum of 3 hours a day, between 8 a.m. and 4 p.m., for 175 days each school year, in the topics of study required for the public schools, in the English language. The instructor may be the parent, as long as s/he has the necessary state teaching credential. Families that are homeschooling in this scenario are not required to file the private school affidavit or report any other information to the state Department of Education.

The CDE website provides information on reporting, testing, attendance and all other requirements for parents who wish to teach their own children in the home. It is each parent’s responsibility to know the legal requirements.

Overview

Students attend school ages 6 through 18

State law requires the instruction be in English and the curriculum to include: reading writing, geography, arithmetic, history of the United States, history of Rhode Island, principles of American Government, health and physical education. Also, beginning with fourth grade, history and government of Rhode Island must be taught. In high school, the U.S. Constitution and Rhode Island Constitution must be taught.

Seek approval from local district, keep attendance records and school 180 days with a minimum of 5.5 hours per day

Rhode Island Department Education does not directly supervise home instruction. In Rhode Island, approval of home instruction occurs at the local school district level.

Parents do not need a teaching certificate and only have to show that they are able to provide “thorough and efficient” instruction.

Parents will need school committee approval before you begin home instruction.

Parents need to present your proposed home-schooling program to your local school committee for approval.Your plan will need to show how you will teach the required subjects.

There should be an agreement between you and your local school committee regarding how your child’s academic progress will be evaluated.

Regular reports should be submitted to the person in charge of home schooling in your district.

Massachusetts Homeschool Laws

Overview

Children between age 6 through 16

Officials may ask about the curriculum, although there are no requirements.

Parents must have prior approval before homeschooling.

Officials expedite approval of home education plans that meet the statutory standard.

Parents give prior notification to school authorities of their home education plan, which equals the local public school’s in thoroughness and efficiency.

Comply with an evaluation program mutually agreed upon by school and parents.

School officials may ask for information regarding qualifications of the parent or parents who will be instructing the children.

Parents are not required to have any specific educational credentials. General Laws provides that teachers shall be of competent ability and good morals.

School officials may inquire about subjects the child will study, length of the homeschool year, and hours of instruction in each subject. While school officials may consider hours of instruction in each subject, they may not dictate the manner in which the subjects will be taught.

In practice this means that parents may calculate hours of instruction based on the manner in which they homeschool, which does not have to replicate the public school’s offering, only equal it in thoroughness and efficiency. Additionally, following a schedule is not an important consideration in a home school where …the perception and use of time… are different.

School officials may identify teaching materials, but only to determine subject and grade level… school officials may not… use this access to dictate the manner in which the subjects will be taught. For example, travel, community service, visits to educationally enriching facilities and places, and meeting with various resource people, can provide important learning experiences apart from the four corners of a text or workbook.

School officials and parents should agree on a method of evaluation that may include one of the following approaches: standardized testing, periodic progress report, or dated work samples.

Home visits may not be required as a condition of approval.
